1. Agreement to Terms
By accessing or using the services provided by Never Touch Practice ("Company", "we", "us", or "our"), including our website and AI infrastructure platform, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you do not have permission to access the Service.
2. Description of Services
Never Touch Practice provides AI automation infrastructure, marketing management (Pay-Per-Lead systems), and operational workflows specifically designed for medical, aesthetic, and wellness clinics. The specific deliverables, including API allocation and hosting provisions, will be detailed in your individual service agreement.
3. Performance & Billing
For our Pay-Per-Lead (PPL) and marketing services, clients are responsible for funding their own direct ad spend (e.g., Meta, Google) independent of our service fees. Our performance fees are billed strictly based on mutually agreed-upon qualified inquiries or appointments as outlined in your contract.
4. Intellectual Property
The Service and its original content, features, logic architectures, and AI prompts are and will remain the exclusive property of Never Touch Practice and its licensors. You retain full ownership of all your clinic's patient data, trademarks, and original content provided to us.
5. Compliance & Responsibilities
While our systems are built with security and privacy in mind, it is the sole responsibility of the clinic to ensure that their overall use of our tools complies with local healthcare regulations (including HIPAA/PHIPA). We act as a technology provider and do not offer legal or medical compliance advice.
6. Limitation of Liability
In no event shall Never Touch Practice, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
